Terms of Service

1. Acceptance
These Terms are an electronic record under the Information Technology Act, 2000 and do not require a physical signature. By creating an account, posting a listing, enquiring on a listing, or otherwise using Spacifyn (the "Platform"), you agree to these Terms and to our Privacy Policy.
If you use the Platform on behalf of a company, firm or another person, you confirm you are authorised to bind them.
2. Eligibility and your account
You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
You are responsible for everything done through your account. Keep your login and OTPs confidential and tell us immediately if you suspect misuse.
You agree to receive calls, SMS, WhatsApp and email from us and from users you transact with in connection with your listings and enquiries, including on numbers registered under DND. You may withdraw this consent by writing to us, which may make parts of the Platform unusable.
3. What Spacifyn is — and is not
Spacifyn is an intermediary under Section 2(1)(w) of the Information Technology Act, 2000. We host listings and connect owners, tenants, buyers and service partners. We are not a party to any sale, lease, rent or service contract you enter into with another user.
Except where you have separately signed a Service Partner Agreement or engaged our paid closing service, we do not act as your broker or agent, do not hold your money, and do not guarantee any transaction, tenant, buyer or outcome.
Titles, approvals, encumbrances, measurements, taxes, occupancy rights and every other legal aspect of a property are for you to verify independently, with your own advocate. Please do so before paying any money to anyone.
4. Listing and posting terms
These rules apply every time you post a property, short stay, requirement, service or shop listing — whether you post it yourself or ask our staff to post it on your behalf.
Right to list. You may list a property only if you are its owner, a co-owner with the other owners' consent, a lawfully appointed power-of-attorney holder, or an agent authorised in writing by the owner. If you are a real estate agent or promoter, you must be registered under the Real Estate (Regulation and Development) Act, 2016 where that Act applies to you, and you must state your RERA registration number in the listing. Advertisements for RERA-registered projects must carry the project registration number.
Accuracy. Every detail you enter — carpet area, price, deposit, floor, age, approvals, amenities, availability — must be true and current. Carpet area must be stated as defined in Section 2(k) of the RERA Act. Do not post bait prices, sold or rented-out properties, duplicate listings for the same unit, or properties you have no mandate over.
Photos and content. Upload only photographs, plans and text you own or are licensed to use. Uploading someone else's images infringes the Copyright Act, 1957 and will get the listing removed. Do not upload images containing other people's faces, vehicle numbers or documents without their consent.
Prohibited listings. You may not list or advertise: properties whose sale or occupancy is restricted by law or court order; unapproved layouts, unauthorised construction, or land under litigation, acquisition or encroachment presented as clear; benami properties under the Prohibition of Benami Property Transactions Act, 1988; agricultural land offered to buyers who cannot lawfully hold it; or any listing that discriminates on the basis of religion, caste, community, place of origin, sex, marital status, disability or food habits.
Legal compliance. You remain responsible for stamp duty, registration under the Registration Act, 1908, TDS under Section 194-IA where applicable, GST, municipal permissions, and — for lease and rent — the Kerala Buildings (Lease and Rent Control) Act, 1965 or the tenancy law applicable in your state. Transactions involving non-resident parties must comply with FEMA and the RBI directions made under it.
Moderation. Listings posted by users go into moderation and become publicly visible only after our team approves them. Listings posted by Spacifyn staff may go live immediately. We may edit formatting, reject, pause, unpublish or delete any listing, and suspend the account behind it, if it breaches these Terms or if we receive a credible complaint or a lawful order. Where required, we act on court or government orders within the timelines set by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Posting entitlements. Free listings, prepaid ad credits and package entitlements are described on the Packages page and are consumed as stated there. Credits are personal to your account, are not transferable, and expire when the package expires. Listings posted by Spacifyn staff do not consume any user's credits.
Removal on your side. Take your listing down, or mark it closed, as soon as the property is sold, rented or withdrawn. Keeping a dead listing live to collect enquiries is a breach of these Terms.
5. Fees, credits, commission and refunds
Fees for packages, featured placement, contact reveals and other paid features are shown before payment and are payable in advance in Indian Rupees through our payment gateway. Applicable GST is charged in addition unless stated otherwise.
In areas where we offer our assisted closing service, you may instead choose to publish on a commission basis. The commission — 15 days' rent for a rental or lease closure, or 1% of the transaction value for a sale, unless the Service Partner Agreement shown to you at the time of posting says otherwise — becomes payable when a transaction closes with a party introduced through the Platform. That agreement, once accepted, governs the commission.
Digital entitlements (credits, featured days, contact reveals) are consumed on use and are non-refundable once consumed. If a payment is debited but the entitlement is not delivered, write to us and we will credit it or refund it. Nothing here limits your rights under the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
We do not collect or hold rent, deposits, tokens or sale consideration on behalf of users. Never pay such amounts to anyone claiming to represent Spacifyn.
6. Verification and badges
A "Verified" badge means we carried out the limited checks described on the listing at the time of verification. It is not a certificate of title, approval, structural safety or fitness, and it does not transfer any risk to us. Continue to do your own due diligence.
7. Things you must not do
Scrape, mirror, resell or bulk-extract listings or contact details; harvest phone numbers for marketing; post spam, abusive, obscene, defamatory or unlawful content; impersonate any person or organisation; interfere with the Platform's security; or use the Platform to circumvent an agreed commission by taking a Spacifyn-introduced transaction off-platform.
8. Content you post
You keep ownership of what you upload. You grant Spacifyn a non-exclusive, royalty-free, worldwide licence to host, display, resize, watermark and promote that content on the Platform and in our marketing while the listing is live and for a reasonable period afterwards. You confirm you have the rights needed to grant this licence.
9. Disclaimers and limitation of liability
The Platform is provided on an "as is" and "as available" basis. We do not warrant uninterrupted service, and we do not verify or endorse users, listings, service partners or the statements they make.
To the maximum extent permitted by law, Spacifyn is not liable for indirect, incidental or consequential loss, or for loss of profit, opportunity or data. Our total liability to you for any claim is limited to the amounts you actually paid us in the twelve months before the claim arose, or ₹10,000, whichever is higher. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Indemnity
You will indemnify Spacifyn and its officers and employees against claims, losses and costs arising from your listings, your content, your transactions with other users, or your breach of these Terms or of any law.
11. Personal data
We process personal data in line with our Privacy Policy and the Digital Personal Data Protection Act, 2023. Contact details revealed to you through the Platform may be used only to pursue that specific property enquiry, and for no other purpose.
12. Grievance redressal
In accordance with the Information Technology Act, 2000 and the Rules made under it, complaints about content or about your use of the Platform may be sent to our Grievance Officer through the Contact page. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.

13. Suspension and termination
You may close your account at any time. We may suspend or terminate access, with notice where practicable, for breach of these Terms, fraud, or where required by law. Unused entitlements are forfeited on termination for breach.
14. Governing law and disputes
These Terms are governed by the laws of India. Disputes will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated at Kochi, Kerala, in English. Subject to that, the courts at Ernakulam, Kerala have exclusive jurisdiction. Consumers retain their right to approach the consumer forums available to them under law.
15. Changes to these Terms
We may update these Terms. The revised version takes effect when posted here, and the date above tells you when it last changed. Continuing to use the Platform after a change means you accept it.
